Employment law cases this week – 5/01/2013 to 11/01/2013

Below is a list of all of the employment law-related case decisions that have been released by the Employment Tribunal and civil courts this week. There were four Employment Appeal Tribunal decisions released but it appears to have been a relatively “slow” week for the civil courts

  1. Mba v London Borough of Merton [2012] UKEAT 0332_12_1312 -religion or belief discrimination – whether the requirement that a Christian work on a Sunday was indirectly discriminatory and whether (if so) such discrimination was legitimate and proportionate
  2. McLauchlun v Chubb Electronic Security Systems Ltd [2012] UKEAT 0235_12_0512 – disability discrimination – whether the Claimant had a sufficiently “significant” disability to qualify him to make a claim under the Equality Act 2010.
  3. Barnet Enfield & Haringey Mental Health Trust v Mars [2012] UKEAT 0052_12_2711 – unfair dismissal – whether the Employment Tribunal had misapplied evidence in the case and whether, therefore, they had misdirected themselves as to their coming to their decision of unfair dismissal.
  4. Aderemi v London and South Eastern Railway Ltd [2012] UKEAT 0316_12_0612 – disability discrimination (again) – whether the Claimant experienced enough problems in his personal and professional life to entitle him to claim a disability under the Equality Act 2010.
